The Investigation Committee, at its meeting on 19 September 2007, determined that Mr Andrew Nigel Hamilton of Andrew Hamilton & Co, 38 Dean Park Mews, Edinburgh EH4 1ED, was in breach of Professional Rule 2.15 of the Professional Rules and Practice Guidelines 2006
The Committee found that Mr Hamilton had failed to notify the Chartered Institute of Taxation, of which he is a member, that disciplinary proceedings had begun to be taken against him by another professional body, namely the Institute of Chartered Accountants in England and Wales; nor did he notify the CIOT after those proceedings had concluded in April 2007.
The Committee ordered that the case should rest on file for three years and that Mr Hamilton should pay costs amounting to £300.
